Alpha Test Privacy Statement

This Privacy Statement describes the privacy & data protection practices of DeepCreative Inc. (“Deep Creative”,”us”, “our”, or “we”) related to the operation of our Software and our conduct of the Alpha Test, as described in our Alpha Test End User License Agreement (EULA). It describes our privacy and data protection practices concerning the personal information we will collect in connection with your participation in the Alpha Test and your agreement to the Alpha Test EULA.


We limit our collection, use, retention, and sharing of your personal information to what is reasonably necessary and proportionate to achieve the purposes for which the personal information was collected as described in this Privacy Statement and in the Alpha Test EULA. We may also use your personal information for purposes that are consistent with the context in which the personal information was originally collected.  We will not use your personal information in a manner that is incompatible with the purposes listed in this Privacy Statement, without getting your prior approval.


Collection. In connection with your participation in the Alpha Test, we will collect a limited amount of personal information from you. Personal information is any information that identifies you or could likely identify you, when combined with other information we collect or that is publicly available.


We will collect the following categories of personal information in connection with your participation in the Alpha Test.


Identifiers/Account Information: You will be required to create an account with DeepCreative in order to participate in the Alpha Test.  In connection with this account creation we will collect your email address and you will create your account using your Google account (gmail) and if you provided your first and last name and a profile picture to Google, we will also receive that information when setting up your account.


Usage Data: As described in the Alpha EULA, we will collect Usage Data from you in connection with your use of the Software and participation in the Alpha Test.  This Usage Data will include, but not be limited to, Device Information, IP Address and behavioral information based on your interactions with the Software during the Alpha Test.


We do not collect any personal information from you that would be considered sensitive personal information under applicable law.,


Use. We will use the personal information that we collect from you in connection with your use of the Software and participation in the Alpha Test.





Account Management. We will use your personal information to manage your account, provide you access to your access, and protect the security of your account.


Product Improvement: We will use usage data, including any personal information contained in it, for purposes of understanding and improving the Software as described in the Alpha Test EULA.


Marketing & Communications. We may use your email to send you information related to your account and our products and services.


Protection & Security. We use industry standard data protection practices to protect the confidentiality, integrity, and availability of the personal information we have collected from you.


Disclosure. We may disclose your personal information to the following third parties:


Service Providers. In order to conduct the Alpha testing and operate our products and services, we may work with service providers who provide services in support of our Software and the Alpha Test.


Law Enforcement or Government Agencies. We may be compelled to disclose your personal information to law enforcement or other government agencies upon the presentation of a valid and legally enforceable subpoena, warrant or letter request


We Do Not Sell Personal Information. We do not sell personal information to any third party, or disclose your personal information to a third party in a manner that could be considered a sale under applicable law.


Consumer Rights. If you reside in the State of California, you have the following rights available to you as it relates to the personal information we have collected from you.


  • Right to know. You can request information about the personal information we have collected about you, including how and why it was collected 

  • Right to delete. You can request that we delete your personal information, as well as any third parties the business may have shared the data with.  Keep in mind, our obligation to delete your personal information upon request is subject to a range of exceptions under applicable law

  • Right to opt-out. You can opt-out of the sale or sharing of your personal information, or the sharing of their personal information for cross-context behavioral advertising

  • Right to correct. You can request that inaccurate personal information be corrected 

  • Right to limit. You can limit the use and disclosure of sensitive personal information

  • Right to data portability. You can receive a copy of your personal information in a format that you can use to take it with you to another business or platform

  • Right to access. You can request specific pieces of personal information collected about you, up to two times in a 12-month period

  • Right to nondiscrimination. We will not discriminate against you for exercising any of your rights available under applicable law

Retention and Deletion.  We will retain your personal information only for as long as we have a legitimate business purpose, and in accordance with our data retention policy as applicable.
